Company was formed in AY 2021-22 and commenced production in AY 2023-24. Form 10ID for claiming benefit of section 115BAB was filed in AY 2023-24 however CPC has raised demand by denying 115BAB benefit. This is because form 10ID was to be filed in AY 2021-22.

Company has filed condonation of delay application to CBDT to allow filing in AY 2021-22 and also filed appeal before CIT(A) against intimation order.

A) Is there any other option available with company as of date?

B) Is there any relevant case law or similar matter where relief has been given or delay condoned?
