Q. immovable property purchased without making payment

An assessee purchased a flat from her father in law vide registered sale deed but the cheques issued could not be realized by the seller (father in law of assessee) , reassessment done by AO and added u/s 69 as unexplained investment and and applied section 115BBE and huge demand of Rs.1.02 crore created , assessee contended that no payment was made for the said immovable property as such the sale deed is void and section 56 (2)(x) also not attracted as father in law covered under relative definition,

When no payment is made by the buyer still the AO made additions u/s 69 and 115BBE applied , is it justifiable ???
