Regulation 39A inserted by Notification No. IBBI/2018-19/GN/REG032 dated 5th October, 2018 (w.e.f. 05.10.2018).

39A. Preservation of records. The interim resolution professional or the resolution professional, as the case may be, shall preserve a physical as well as an electronic copy of the records relating to corporate insolvency resolution process of the corporate debtor as per the record retention schedule as may be communicated by the Board in consultation with Insolvency Professional Agencies.

What was the condition when an IRP/RP handed over the documents to the new RP before 05th October 2018.

Hello Rita ji,

Although IRP/RP handedover the documents to new RP. You can have a communication with new RP to arrange for you a copy(ies) of all documentation as per Regulation 36A after signing of NDA.
