can benami act be applied in this case to the company of which the company is shareholder.

In such a case the shareholder is non-existent. The question of Benami law would be there however one should take care that such shares could belong to the government. Further in the amended schedule III now the detail of such shareholders had to be given in notes to the accounts for financial year 21-22 onwards.
